Any aggrieved women may make, in writing, a complaint of sexual harassment at workplace to the Internal Committee within a period of three months from the date of incident.

As per directions of the Honorable Supreme Court in SLP No.-24295 of 2006 dated 16/05/2007 and in Civil Appeal number 887 of 2009, dated 08/05/2009, the Ragging is completely banned.  WOMEN CELL 

The Women Cell is constituted to help maintain a harmonious atmosphere at the Institute, to enable women to pursue their work with dignity and reassurance. The Cell has been working to raise awareness on gender equality issues.

Sexual harassment at a workplace is considered violation of women's right to equality, life and liberty. It creates an insecure and hostile work environment, which discourage women's participation in work, thereby adversely affecting their social and economic empowerment and the goal of inclusive growth. With this idea the legislature formulated the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act 2013.

Objectives of the Cell

•           To   prevent   sexual   harassment   and   to   promote   the    general   well‐being   of    female students/employees of the Institute.

•           To    provide    the    healthy    and    safe    environment    in    the    Institute   for    the    female students/employees.

•           To provide guidelines for the redressal of grievances related to sexual harassment of female students/employees of the institution. 

Prohibited Activities

Sexual harassment has been defined as a form of sexual discrimination, consisting of unwanted sexual advances.

Complaint procedure

Any female who wants to file a complaint can do so by writing an application to the Chairperson of WGRC. In case of Sexual harassment the complainant shall include the specific nature of the incident, date and the place of the incident, name of all parties involved as well as a detailed report of all pertinent facts.

A member who feels that she has been harassed is strongly urged to immediately bring the subject to the attention of a member Women’s Redressal Committee. Inquiries and/or complaints will be investigated as quickly as possible. Any investigation will be conducted in confidential manner as compatible with a thorough investigation of the complaints.

Discipline

Any member found to have harassed another member or guest will be subject to appropriate disciplinary procedure action, including reprimands, suspension or termination of membership.

a)  A person committing sexual harassment may also be held legally liable for his or her actions under applicable law.

b)  Institute will endeavor to protect members, to the extent possible, from reported harassment by non-members such as from invited guest, hosting organization, vendors and other parties who have organizational contact with our members.

Complaint and Redressal mechanism:

  Complaint of harassment will be promptly and carefully investigated and Investigation will     include interview with all relevant persons, including the aggrieved and other potential witnesses in the case of sexual harassment and decision on grievances to be taken at a fairly senior level.

After hearing of complaints, the committee shall take appropriate decision and then same is communicated to the complainant if required. If any student filing a complaint is not satisfied with the decision of the committee then she can make appeal before the Director of the Institution. A women grievance redressal committee shall take rational decisions to discharge its duties/responsibilities for a smooth and efficient functioning of the Institute and to monitor, or the overall discipline. 

Punishment for Sexual harassment

Harassment shall subject the accused to disciplinary action up to and including expelling from Institute. However, if in fact it is determined through the course of investigation, that the incident and thus the accusation were fabricated, the complainant will face severe disciplinary action up to and including expelling from the Institution as per the prevailing rules of the Government sexual harassment policy.

Ragging in the institute is strictly forbidden. If someone finds themselves involved in such practices, strict steps will be taken regardless of their scope. The Supreme Court of India has banned ragging. In order to prevent such kind of action in campus, an anti-ragging committee has been established and brought into service even before the start of 1st year classes by the Director

 RAGGING

Ragging elaborates to force to obey different orders like vulgar questions, drink Alcohol, tea scalding, smoking, etc., conduct actions that can lead to physical harm, torture of mind or death, deal with the seniors as 'Sir’,  copy class notes for seniors, forced for menial tasks for the seniors , forcefully look at porn pictures to shock fresher's innocence.

RESPONSIBILITIES

It shall be the duty of the Anti-Ragging Committee to ensure compliance with the provisions of these Regulations as well as the provisions of any law for the time being in force concerning ragging; and also to monitor and oversee the performance of the dedicated Anti-Ragging Squad in curbing the menace of ragging in the institution. 

Every institution/constituent colleges shall form a smaller body to be known as the Anti-Ragging Squad to be nominated by the Head of the Institution with such representation as may be deemed necessary for maintaining vigil, oversight, patrolling and shall remain dynamic, alert and active at all times. 

Anti-Ragging Squad would be deployed to make surprise visits in sensitive areas, including canteen, and other places that has the potential of prompting ragging and shall be empowered to inspect such places.

ACCOUNTABILITY:

Anti-Ragging Committee and Anti - Ragging Squad at the level of the Institutions should be a monitored by a committee at the university level. 3. The wardens must be accessible at all hours and therefore it is imperative and mandatory that they, be available on telephone and other modes of communication. Similarly, the telephone numbers of the other important functionaries - Heads of institutions, faculty members, members of the anti-ragging committees, where ever relevant, should also be widely disseminated for the needy to get in touch or seek help in emergencies. 4. A copy of the prospectus distributed to each student at the beginning of each academic session for obtaining an undertaking not to indulge or abet ragging, shall contain the blueprint of prevention and methods of redressal. 5. It is ensured that each hostel would possess a full-time residential warden.  

DISCIPLINARY ACTIONS FOR RAGGING CASES

In relation to the nature and seriousness of the offence defined by the College Anti-Ragging Committee, one or any combination of the following shall be the potential penalty for those found guilty of ragging:

1. Suspension from the course

2. Debarred from the every test or other assessment process

3. Cancellation of Admission

4. Combined punishment in case the individuals committing ragging are not identified.

5. Strict prison and fined Rs. 2.5 lakhs in compliance with law.

 

Process for addressing the complaint

1.      A method of inquiry that requires the respondent to have complete knowledge of the evidence against him before he presents his defense.

2.      Cross-examination procedures for parties and their witnesses, module by the guiding principles of gender sensitivity and non-compulsion.

3.      Provision to all parties with authenticated depositions.

4.      Interview official witnesses with procedural objections.

5.      Prepare an enquiry report

Grievance Redressal Mechanism for Students 

Introduction

A grievance is any kind of discontent or dissatisfaction or negative perception, whether expressed or not, arising out of anything connected with Institution that a student thinks, or even feels, is unfair, unjust or inequitable. For smooth running of the institutions, it is necessary to pay immediate attention on these grievances and complaints. Due to different social background and various psychological factors students occasionally have to be uncomfortable or aggrieved about certain decisions, practices or conditions. In order to redress individual as well as collective grievances of the students the IMS Ghaziabad University Courses, a grievance redressal mechanism has been devised in 1st August 2016.

The IMSUC Grievance cells regularly hold meetings and take action to address these complaints. The cell's purpose is to analyze and judge the validity of complaints lodged by a college student. In addition, the grievance cell is entitled to discuss abuse issues. Everyone with a serious complaint can approach the representatives of the department in person or in consultation with the students Grievance Cell Officer-in-charge. If the person does not wish to appear in person, complaints can be dropped in a Complaint box/ Learning management systems (LMS) in writing. Grievances can also be e-mailed to the Student Grievance Cell member/officer

OBJECTIVES

The goal of the Grievance Cell is to establish responsiveness, transparent and the harmonious educational atmosphere of the institute. IMS University Courses Ghaziabad Grievance Cell established addresses the following objectives:

1. Encouraging students openly to share their concerns/problem honestly and without apprehension of being victimized.

2. To promote the dignity of the college by maintaining a conflict free environment in the college through the promotion of friendly ties between student-student and student-teacher etc.

3. It is advised that all staff to be gracious to the student and do so for no cause whatsoever.

4. In and outside of the institution, ragging in any manner is strictly forbidden, any violations of the laws of ragging and discipline must be reported to the Director urgently.

5. Advising College students to respect one another's rights and integrity and to practice extreme temperance and patience.

6. Complaint Box is set up in the atrium, whereby students who wish to remain unsigned may put their complaints and suggestions in writing on the improvement of the college's academics and administration.

Scope of application

The cell will discuss some of the following matters obtained in writing from the students:

Scholastic subjects: timely issue of Marksheets, transfer certificates, certificates of conduct or other examination-related issues etc.

Fiscal Matters: Responsibilities and payments related to different library items, hostels, etc.

Any Other Matters: Concerning some questions regarding hygiene conditions, food preparation, transportation available, teacher victimization, etc.

Function

With this platform the students can raise their concerns in an open manner, to deserve the attention of this committee it comprises of senior administrators and faculty of the IMS University Courses Ghaziabad. The cases shall be heard immediately when written complaints are received by the students. The cell shall investigate all cases formally and shall function accordingly in compliance with management policy.

*Note

1.      The committee will not recommend appropriate action against complainant(s), if complaint made are found to be baseless or insignificant.

2.      Management of the Institute may revise the procedure from time to time.

 

Procedure for filing the formal complaint/grievance:

1.      Any student IMS Campus, may lodge a complaint.

2.      Complaint may be oral, by email or in writing. If the complaint is oral, it will be converted into a written form by the person who received the complaint and authenticated by the complainant under his / her signature as soon as possible.

3.      Upon receipt of complaint by any member of GRC, the member should forward it to concern department.

4.      If the complainant would not like to reveal his/her name for any grievance, they can drop the grievance(s) in the drop box placed inside the Campus.

5.        The student can address their complaint through their individual ERP / LMS portal

Process for addressing the Grievance:

1.      Upon receipt of complaint Committee will send a response to the complainant acknowledging the receipt of grievance immediately.

2.      At this stage, based on the nature of the complaint and severity of its possible impact, the committee may take one of the two options to proceed on addressing the concerns while keeping the Director, Chairperson copied in all communication

3.      The Committee may address the issue directly with the help of the concerned department.

4.       In this case, it is important that the complainant is apprised of the actions taken or the work-in-progress in a timely manner.

5.       Once the matter has been resolved the committee will send a final update to the complainant on the matter.

6.      Final decision of the committee has to be communicated to the student within 15 days of the receipt of the complaint.

7.       The Committee will communicate the decisions to the concerned parties/departments via email and a copy of the case and decision will be sent to the Director.

8.      The Secretary will maintain an updated record of all complaints, actions taken and closure status.
